Terms of Service
In short: Fanalytics is a business tool for measuring how brands appear in AI answers. Use it lawfully, keep your login to yourself, and remember that AI answers vary and our figures are measurements, not guarantees. Your data stays yours.
1. Who we are and what these terms cover
Fanalytics (www.fanalytics.app) is operated by Metsander.nl, based in the Netherlands ("we", "us"). These terms apply to your use of the Fanalytics website, web application and browser extension (together, "the service"). By creating an account or using the service, you agree to them.
If you have a separate written agreement with us, that agreement takes precedence where it differs from these terms.
2. Accounts
- You need an account to use the service. New accounts are activated by us before they can be used.
- Give a real email address and keep it up to date. We use it for account and service messages.
- Keep your password to yourself. You are responsible for what happens under your account. Tell us straight away at sander@metsander.nl if you think someone else has used it.
- If you use the service on behalf of a company, you confirm that you may accept these terms for it.
3. Using the service
You may use Fanalytics for your own business purposes and those of your clients. You may not:
- break any law, or use the service to infringe anyone's rights;
- try to get access to accounts, data or parts of the service that are not yours;
- disrupt, overload or probe the service, or get around its limits or security;
- copy, resell or rebuild the service itself, or scrape it with automated tools beyond the features we provide;
- use it to send spam or to create misleading content;
- break the terms of the AI services the service works with.
4. Your data
- The groups, prompts, brands and other content you put into Fanalytics remain yours, as do the results we produce for you.
- You give us permission to store and process that content only as needed to provide the service to you.
- You are responsible for that content: that you may use it, and that it contains no other people's personal data or sensitive data such as health, financial or identity details. Prompts are sent to the AI services in section 5. If your content does contain personal data, you are the controller of that data and we process it for you as your processor, as described in the Privacy Policy. Business customers can ask us for a data processing agreement.
- If you share a group or dashboard with other people in Fanalytics, they can see that data. You decide who.
- How we handle personal data is described in our Privacy Policy.
5. Third-party services
- Fanalytics sends your prompts to AI and search data services (such as OpenAI, Google, Perplexity and DataForSEO) to collect their answers. Their availability and behaviour are outside our control.
- Your own API keys. If you add your own keys for such services, the requests you set up run on your account with that provider, and any costs they charge are yours. Keep an eye on your usage there.
- Google. If you connect a Google account, Fanalytics creates spreadsheets in your Google Drive and keeps them updated. Your use of Google is also governed by Google's own terms. You can disconnect at any time; the spreadsheets stay in your Drive.
- Google Search Console. When this feature is available and you link a Search Console site to a group, Fanalytics reads that site's search performance figures (read-only) and shows the analysis to everyone with access to the group. Only link a site you are allowed to share that way.
6. AI answers and our figures
AI services give different answers to the same question, change over time, and can be wrong. Fanalytics measures what they say; it does not control it. Our figures, scores and analyses are provided as information to support your decisions. They are not guarantees of any result, ranking or visibility, and you remain responsible for the decisions you make with them.
7. Availability and changes
We work to keep Fanalytics available and correct, but we cannot promise it will always be available, uninterrupted or error-free. We may carry out maintenance, and we may change, add or remove features. If we remove something important you rely on, we will try to tell you in advance.
8. Payment
If you use Fanalytics under a paid arrangement, the prices and payment terms are those agreed with you separately.
9. Intellectual property
The service itself, including its software, design and documentation, belongs to us. These terms do not transfer any of it to you; you get the right to use the service while your account is active.
10. Liability
- We are not liable for indirect or consequential loss, such as lost profit, lost revenue or lost data, or for decisions made on the basis of the service's figures.
- Our total liability to you is limited to the amount you paid us for the service in the twelve months before the event that caused the loss, or 500 euros if you paid nothing.
- These limits do not apply where the law does not allow them, including in cases of intent or gross negligence.
11. Ending your use
- You can stop using Fanalytics at any time and ask us to delete your account at sander@metsander.nl.
- We may suspend or close an account that breaks these terms, puts the service or other users at risk, or has been inactive for a long time. Where reasonable, we will warn you first.
- After an account is closed, we delete its data as described in the Privacy Policy. Spreadsheets in your Google Drive are yours and are not affected.
12. Changes to these terms
We may update these terms. We will publish the new version on this page with a new effective date. We tell account holders by email before the change takes effect if it limits what you can do with the service, adds obligations for you or changes our liability. Changes that only make the text clearer are published without an email. If you keep using the service after a change takes effect, the new terms apply.
If Fanalytics or Metsander.nl is merged, acquired or sold, we may transfer these terms to the new owner. We will tell you by email; the Privacy Policy describes what happens to your data.
13. Law and disputes
These terms are governed by Dutch law. Disputes go to the competent court in the Netherlands, unless mandatory law gives you the right to go to a court elsewhere.
